JUDGMENT / ORDER

Petitioners have approached this Court complaining about the refusal on the part of the revenue authorities in effecting mutation of the property. According to them, they are bona fide purchasers for value and Exts. P1(a) and P1(b) are the sale deeds in his favour. 2. The learned Government Pleader, on instructions, would submit that the previous owner is having sales tax arrears and therefore attachment has been effected as per Ext. P 3 on 28.2.2013.
3. It is clear from the sale deeds produced that sale was effected after the order of attachment. In fact, even if the order of attachment is on 28.2.2013, the Sales Tax Department has a charge from the date from the amount becomes due.
4. In the light of the aforesaid factual circumstances, the petitioners are not entitled to seek the reliefs prayed for unless the charge on the property is released by payment of the dues to the Government.
-: 2 :-
Therefore, there is no merit in the writ petition and accordingly the same is dismissed.
Sd/- A.M. Shaffique, Judge.
