Petitioner approached this Court aggrieved by Ext.P1 proceedings initiated by the third respondent. According to the petitioner, there is a dispute regarding identification of the property. Petitioner has approached the third respondent to determine the boundaries with reference to the title deeds of the petitioner's property.
2. Petitioner submits that without considering the identity of the property, proceedings initiated under the Land Conservancy Act is unsustainable.
3. I am of the view, in the light of Ext.P9, the third respondent shall take necessary steps to identify the property based on the title deed of the petitioner before proceeding further with Ext.P1. Therefore, there shall be a direction to the third respondent to consider and take decision based on Ext.P9 to identify the property after hearing the petitioner as well as the second respondent. Needful shall be done within a period of two months from the date of receipt of a copy of this judgment. Till then, all proceedings pursuant to Ext.P9 shall be kept in abeyance.
The Writ Petition is disposed of as above.
