K.Narayanan vs National Federation Of The Blind

Madras High Court|23 February, 2017

JUDGMENT / ORDER

The respondent/plaintiff filed the suit in O.S.No.485 of 2011 for permanent injunction restraining the revision petitioners/defendants from in any manner conducting the General Body Meeting either on 31.07.2011 at Trichy or any other future days in the name of the plaintiff-Federation and its Registration No.6 of 1977. It is the grievance of the revision petitioners that the suit is pending without any progress. It is further stated that the defendants have filed written statement in 2012 itself. Pending suit, there was an order of interim injunction granted on 30.07.2011. It is further stated that even the issues have been framed in the suit on 06.07.2013. It is the further grievance of the petitioners that because of the pendency of the suit, the interest of the members, being blind, is affected. Hence, the revision petitioners/defendants pray for early disposal of the said suit. Taking into consideration the above facts and taking into account the fact that the suit is pending for the past five years and considering the fact that the members of the plaintiff-Federation are blind, while taking a sympathetic view, this Court directs the learned Principal District Munsif, Alandur, to dispose of the said suit in O.S.No.485 of 2011, on or before 31.12.2017. With the above observations and direction, the Civil Revision Petition is disposed of. No costs.
