Conviction and sentence under Section 138 of the Negotiable Instruments Act are under challenge in this revision. Pending the proceedings the parties amicably settled the dispute out of court and filed composition. The composition was accepted and permission for composition was granted on Crl. MA 3389/14. Hence the conviction and sentence against the revision petitioner under Section 138 of Negotiable Instruments Act in C.C No. 636/1998 of the Chief Judicial Magistrate Court, Kasargod are set aside, and the revision petitioner is released from prosecution on the benefit of acquittal under Section 320 (8) Cr.P.C.
