K.Manimegalai vs The District Project Officer

Madras High Court|14 September, 2017

JUDGMENT / ORDER

Challenging the impugned order of the respondent in Proceedings No.1612/A1/03 dated 11.10.2004, the present Writ Petition has been filed.
2. The case of the petitioner is that earlier, she was working as Anganwadi Worker at Illuppaigudi, Alathur Block, Perabalur District. At the time of filing of the Writ Petition, the petitioner was working as a Child Welfare Organiser at the Child Welfare Centre, Thimmur till 18.3.2004. While so, two new centres were opened at Iluppaigudi and Thimmur-A. By oral instructions, the petitioner was transferred to Illuppaigudi Centre. Thereafter, the District Project Officer, Perambalur, has issued an order dated 11.10.2004, transferring the petitioner to Thimmur-A Centre wherein earlier, she worked as Anganwadi worker. Challenging the above said transfer order, the present Writ Petition has been filed.
3. A Counter Affidavit has been filed by the respondent wherein it is averred that on 30.01.2004, the Government has opened 172 new centres in Perambalur District and accordingly, the centres were started functioning from 18.3.2004 onwards. Due to lack of sufficient hands, the workers of nearby centres were deputed to the new centres on a temporary measure till regular hands are posted. As such, Tmt.K.Manimekalai, Anganwadi worker of Thimmur centre was temporarily deputed to Iluppaigudi centre w.e.f. 18.3.2004. Subsequently, in the month of October, 2004, the vacant places were filled in which the surplus staff of adjacent centre, namely, Tmt.Janaki from Koodalur centre was posted to Iluppaikudi and the petitioner was posted to her original station Thimmur. Accordingly, the petitioner may not have aggrieved by the transfer order since she was posted in the regular place where she worked earlier. Hence, the respondent prays for dismissal of the Writ Petition.
4. Heard both sides and I have also gone through the materials available on record.
5. A perusal of the counter affidavit filed by the respondent would give a clear picture about the transfer of the petitioner and it is also seen that the petitioner was thereafter transferred to her original place where she worked earlier. Further, this Court is of the view that after a lapse of 13 years nothing survives for adjudication in this Writ Petition. Accordingly, the Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petitions are also closed.
14.09.2017 To The District Project Officer, Perambalur, Perambalur District.
