Heard learned counsels for parties.
The instant writ petition has been preferred seeking the following reliefs:-
(A) Issue a writ order or direction in the nature of mandamus directing to the respondents to restrain the respondent no.6 to function as the post of Gram Rojgar Sevak of Gram Panchayat Chhibra Block Kudraha District Basti.
(B) Issue a writ order or direction in the nature of mandamus directing the respondents to select the petitioner as post of Gram Rojgar Sevak of Gram Panchayat Chhibra Block Kudraha District Basti in view of scheme and Advertisement 7- 12-2007 (Annexure-2)."
Learned counsel for the petitioner apprises the Court that although the original appointment of the sixth respondent has not been challenged, he continues to work in that capacity even today. Be that as it may, in the absence of any challenge to the original appointment, no cause arises for the Court to consider the grant of the reliefs as prayed for.
If the petitioner be correct in his submission that the contractual engagement of that respondent has since been renewed, it would be open for the petitioner to question any renewal of contract that may have been made, if otherwise permissible in law.
The instant writ petition shall stand dismissed.
