The petitioner submits that he is the owner and in possession of 37 cents of property comprised in old Survey No.172/15-A of erstwhile Adoor Village. It is further submitted that the property covered under old survey No.172/15-A is now divided into two sub divisions and an extent of 13 Ares 10 sq. mts. is now included in Resurvey No.124/14 showing 'Cheriyan Muthalali' as the registered owner in respect of the same and the balance extent of 3 Ares 23 sq. mts. was shown as Government land in Resurvey No.124/15. The petitioner submits that on account of the mistake crept in the Resurvey, this property was shown as a Government land. Therefore the petitioner has approached the Director of Survey, Kerala by Ext.P1. 2. I am of the view that the petitioner shall approach the District Collector, Pathanamthitta under Sec.13A of the Survey and Boundaries Act, 1961. If the petitioner makes an application before the District Collector, Pathanamthitta within four weeks from the date of receipt of a copy of this judgment, the District Collector shall consider and pass appropriate orders on the application, after affording an opportunity of hearing to the petitioner, within a period of three weeks thereafter.
