The writ petition has been filed to seek a direction to the respondents no.2 and 3 to restrain the respondent no.4 to create any disturbance or hindrance or nuisance in the possession of the petitioner in the light of the complaint dated 26.07.2021.
Learned counsel for the petitioner could not show authority of respondents no.2 and 3 to enter into the private dispute between the parties.
At this stage, reference of the interim order passed by the Court has been given. It is stated that the direction given therein have been flouted by the respondent no.4. If that is so, learned counsel for the petitioner could not explain why a contempt petition was not filed.
In view of the above, we don't find that the prayer made by the petitioner cannot be granted.
If an interim order exist, petitioner is always at liberty to take appropriate proceeding if somebody is acting contemptuously, but for that, writ petition would not be maintainable and is accordingly dismissed.
