Shri Paras Nath Rai, learned counsel for the respondents raises a preliminary objection. He contends that the petitioner has an alternative remedy to approach the Central Administrative Tribunal. He relies on the law laid down by the Supreme Court in L. Chandra Kumar Vs. Union of India, reported at (1997) 3 SCC 261.
Faced with this, Shri Jagannath Singh, learned counsel for the petitioner does not dispute the aforesaid proposition of law. He does not press the relief sought in the writ petition. He recasts his relief and submits that the petitioner may be permitted to avail such alternative remedy available to him.
It is always open to the petitioner to avail the remedy available to him in law.
The writ petition is disposed of.
