Petitioner has scored 415.5 marks in the recruitment exercise undertaken for appointment to the post of Constable (Female) in U.P. Police. According to petitioner, the cut off in the respective category of OBC candidate is 410.6. Petitioner's grievance is that though she has scored marks above the cut off, yet her claim for appointment has not been considered. Attention of the Court has been invited to OBC certificate dated 13.2.2016, which has been clearly mentioned in the online application form.
It appears that OBC certificate of the petitioner is of the period prescribed in the advertisement. Law has otherwise been settled by the Full Bench of this Court in Gaurav Sharma Vs. State of U.P. and Others reported in (FB) 2017 (5) ADJ 494. No reasons have otherwise been disclosed to discard the petitioner's candidature once she has scored above the cut off marks.
Learned Standing Counsel submits that grievance of petitioner shall be examined, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent nos.2 and 3 to accord consideration to petitioner's candidature for appointment to the post of Constable, in accordance with law, by passing a specific order, within a period of two months from the date of presentation of certified copy of this order.
