Heard Dr. C.P. Upadhyay and Shri SA Shah, learned counsel for the applicant, Shri Mohit Singh, learned counsel for the complainant and learned AGA.
It is argued by the learned counsel for the applicant that the applicant is the mother-in-law and all the other accused persons including the husband have been granted bail by the trial court. The cause of death was strangulation and usually the husband is liable for strangulating the wife.
Learned counsel for the complainant, however, argued that the husband was granted bail wrongly by the trial court on the ground of parity with Nand.
In this view of the matter, without expressing any opinion on the merits of the case, let the applicant-Smt. Siya Devi, involved in case crime No. 300 of 2009, under sections 498-A/304-B IPC and 3/4 of Dowry Prohibition Act, police station Chandausi, district Moradabad be released on bail on her furnishing a personal bond with two surties each in the like amount to the saitsfaction of the court concerned.
