The petitioner are claiming to be teachers working in primary section of the institution-in-question. It is contended that the primary section is attached to the Junior High School being in the name of Sri Shiv Narain Shiksha Sadan, Sultanpur Bhawa, Gangaganj, Allahabad.
Pursuant to the order of Apex Court in Pawan Kumar Dwivedi, 2014 (4) ESC 506 (SC), representation had been filed by the Manager to bring the attached primary school in the grant-in- aid list.
Submission is that the District Basic Education Officer, Allahabad had submitted his report to the Director of Education (Basic), U.P., and the matter is pending at the ends of respondent no.1, namely, the Secretary, Basic Education, Secretariat, Lucknow.
Be that as it may, in view of the only prayer made by the learned counsel for the petitioner to issue a direction to the respondents, to consider the aforesaid claim, the present petition is being disposed of with the direction to the respondent no.2, Director of Education (Basic) Lucknow, U.P. to take a final decision, as expeditiously as possible, with regard to the claim of the institution-in-question of being attached primary school to the Junior High School. The relevant reports from the Committee of Management, District Basic Education Officer and from the office of the Director of Education shall be obtained by the respondent no.1, Secretary, Basic Education, Secretariat, Lucknow, before taking such a decision by passing a reasoned and speaking order, in accordance with law, preferably, within a period of two months from the date of submission of certified copy of this order, under due intimation to the Committee of Management.
It goes without saying that this Court has not entered into the merits of the claim of the petitioner.
