Heard learned counsel for the parties.
The petitioner seeks to challenge the final select list dated 21.5.2018 with the assertion that the petitioner has wrongly been excluded from the select list though she had obtained higher marks than the last selected candidates in OBC.
It is contended that the petitioner has cleared all stages of examination and had appeared in the document verification process. After the final select list was declared on 21.5.2018, she came to know that she was not selected and hence this writ petition.
On a pointed query made by the Court as to whether the petitioner fulfils all eligibility criteria as required in the advertisement, a copy of the application form, the domicile certificate and the OBC certificate, pages '31', '33' and '37' of the paper book was brought before the Court.
A perusal of the said documents shows that the domicile certificate of the petitioner was dated 24th December, 2012 and the OBC certificate was dated 12.8.2010 and moreover, the said certificate does not disclose that the petitioner belongs to OBC (non-creamy layer). As per the advertisement, a candidate was required to submit OBC certificate of certifying him of belonging to non-creamy layer between 1st April, 2015 to 29th February, 2016.
The certificates submitted by the petitioner do not fall within the said period as prescribed in the advertisement.
In view thereof, the petitioner cannot be said to be qualified for being considered as an O.B.C. category candidate in the selection process.
The writ petition is, accordingly, dismissed. Order Date :- 31.5.2018 Brijesh
