Heard Sri Prashant Ji Pandey, learned counsel for the petitioners and Sri Vinod Kant, learned A.G.A. assisted by Sri Jhamman Ram, learned A.G.A. for the State.
In compliance of order dated 02.11.2021 petitioner No.1- Mrs Roshani @ Laxmi (Corpus) has been produced today in the Court by S.I. Ramcharan Singh and Mahila Constable Ms. Anjali Kashyap, Police Station- Biharigarh, Dsitrict- Saharanpur. They informed the Court that they have produced the petitioner No.1- Mrs Roshani @ Laxmi (Corpus) from the custody of Ravindra @ Mukhiya, resident of village- Santarshah, Bahadarpur, Police Station- Bahadarbad, District- Haridwar, Uttarakhand.
According to school leaving certificate date of birth of the corpus is 01.06.2003 and she has attained the age of majority on 01.06.2021.
Petitioner No.1- Mrs Roshani @ Laxmi (Corpus) stated before the Court that she is living with Ravindra @ Mukhiya and she has married with him. She is not willing to live with her father- petitioner no.2. She shown her willingness to stay with respondent no.4- Ravindra @ Mukhiya.
As petitioner no.1 is major and she is not willing to live with petitioner no.2, she may be set at liberty to go wherever she wants. S.I. Ramcharan Singh and Mahila Constable Ms. Anjali Kashyap shall ensure to escort the corpus to her destination in proper security.
With the aforesaid directions, the writ petition stands finally disposed of.
