Supplementary affidavit filed today is taken on record.
Heard Sri Arvind Yadav, counsel for the petitioner and Sri Rohit Pandey, learned counsel for the respondent-University.
The present writ petition has been filed with the following reliefs:-
"a. issue a writ, order or direction in the nature of Mandamus direct the respondent no.2 and 3 to re-check the entire Examination Copies of Roll No. 1910127460080 (Km. Sinku, Daughter of Yashoda Nand Yadav), B.Sc.- Part- III year, Maths and Physics Examination-2019 in Saraswati Devi Mahavidhyalaya, Nandapur, Jaitpur, District Gorakhpur within stipulated period as fixed by this Hon'bble Court and further be pleased to direct the respondents to produce the entire records/ Answer-sheet of Roll No. 1910127460080 (Km. Sinku, Daughter of Yashoda Nand Yadav), B.Sc.- Part- III year, Maths and Physics Examination-2019 in Saraswati Devi Mahavidhyalaya, Nandapur, Jaitpur, District Gorakhpur within stipulated period as fixed by this Hon'bble Court b. issue any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case."
A preliminary objection has been raised by Sri Rohit Pandey, learned counsel for the University that the petitioner has not applied for scrutiny and there is no provisions of re-valuation of marks in the statutes of the University.
In the facts and circumstances of the case, the petitioner is directed to apply for scrutiny of the marks before the concerned respondent within one week from today along with certified copy of this order. In case such an application for scrutiny is made by the petitioner as indicated above, the authority concerned of the respondent University shall take appropriate decision thereon as expeditiously as possible preferably within a period of one week thereafter in accordance with law.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
