Heard learned counsel for the applicant and Sri K.R. Singh, learned Additional Chief Standing Counsel for opposite party.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the orders dated 04.08.2015 passed in Writ Petition No.67725 of 2012 (Km. Reshu Vs. State of U.P. and others).
By the aforesaid order, directions were given to the Opposite Party to pass appropriate orders in accordance with law in terms of the law laid down in Archana Gautam Vs. State of U.P. and others (Writ Petition No.4913 of 1996).
Pursuant to the order of this court, affidavit of compliance on behalf of opposite party has already been filed which is on record. It is stated in paragraph 8 of the affidavit that in compliance of the aforesaid order, order dated 03.12.2015 has been passed by rejecting the claim set up by the applicant.
After some arguments, a prayer has been made to dismiss the present contempt application as withdrawn with liberty to challenge aforesaid order before appropriate forum.
Prayer is granted.
The present contempt application is dismissed as withdrawn with liberty as prayed.
