By means of the instant writ petition, the petitioner is seeking a writ, order or direction in the nature of mandamus commanding the Naib Tehsildar, Tehsil Sadar (Chinhat), District Lucknow to decide the application for mutation moved under Section 34 of the U.P. Land Revenue Act, moved by the petitioner, with respect to Gata No. 49 Sa area ad-measuring 0.0380 hectare, situated in village Husainiya, Pargana, Lucknow Tehsil Sadar, District Lucknow, expeditiously.
A perusal of the record reveals that the petitioner preferred a Writ Petition No. 3850(MS) of 2008 (Km. Ranjana Srivastava vs. Tehsildar, Tehsil SadarDistrict Lucknow and another) and the said writ petition was disposed of vide order dated 07.08.2008 with a direction to opposite party no.1 (Tehsildar, Tehsil Sadar, District Lucknow) to consider and decide the mutation application dated 21.06.2007, latest by 31.10.2008 by means of a speaking and reasoned order, after affording opporutnity of hearing to the petitioner.
Submission of learned counsel for petitioner is that even after passing of the order dated 07.08.2008, the application of the petitioner has not been decided by the Tehsildar, Tehsil Sadar. This Court is constraint to observe that it is a very sad state of affair.
At this stage, learned Standing Counsel prays for and is granted time to seek instructions in the matter as to why after passing of the order dated 07.08.2008, by this Court, the same has not been complied with.
