The submission of learned counsel for the petitioner is that petitioner is a regular Head Mistress of Intermediate College, Para, Hamidpur, District Pratapgarh (here-in-after referred to as the "College"). The petitioner was placed under suspension vide order dated 11.10.2008. The District Inspector of Schools, Pratapgarh by means of order dated 21.07.2011 revoked the suspension order of the petitioner with further directions to the Committee of Management of the College to take work from the petitioner to the post of Head Mistress and pay her salary regularly every month.
Despite the said order, the petitioner was not allowed to resume her duties as Head Mistress and in the meantime Shri Pradeep Kumar Singh, Assistant Teacher of the College, who was given charge of the post of Head Master during the period of petitioner's suspension, died and now the District Basic Education Officer by means of order dated 30.03.2012 directed for attesting the signature of Smt. Asha Maurya, who is much junior to the petitioner. The petitioner feeling aggrieved against the said order of the District Basic Education Officer, Pragapgarh approached this Court by means of present writ petition.
Learned Counsel for the District Basic Education Officer, Pratapgarh is hereby directed to seek instruction within a week as to why the charge has not been given to the petitioner, who is regular Head Mistress of the College in question and has been reinstated vide order dated 21.07.2011 and how the charge has been directed to be given to Smt. Asha Maurya, who is much junior to the petitioner.
