JUDGMENT / ORDER

It is contended by Sri L.K.Dwivedi, learned counsel for the petitioners that the petitioners' mark-sheet of Shashtri IInd year was issued very late and pursuant to the letter dated 10.5.2010 issued by Deen Student Welfare those students whose marksheet have been issued late were entitled to deposte their Forms up to 12th May, 2010. In the submissions of Sri Dwivedi even after depositing the Form on 12.5.2010 in the office of Deen Student Wellfare well within time, it was not accepted for the reason that it was not forwarded by the department.
I have heard the learned counsel for the petitioners and Sri Vikrant Pandey, holding brief of Sri V.B. Mishra, appearing for the University. Considering the facts and circumstances of the case, the learned counsel for the respondents is directed to file counter affidavit within a period of four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List this case in the third week of August, 2010. As an interim measure, without prejudice to the right and contention of the parties, the respondents are directed to accept the petitioners' forms provisionally and issue admit cards to them for appearing in the examination which is scheduled to be held w. e. f. 24.6.2010 . The copy of the order be supplied to the learned counsel for the petitioners on payment of usual charges within 24 hours. Order Date :- 21.6.2010 Manoj
