Court No. - 34
Case :- WRIT - A No. - 3799 of 2021 Petitioner :- Km. Nidhi Sharma Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Hemant Sharma Counsel for Respondent :- C.S.C.
Hon'ble Yashwant Varma,J.
Heard learned counsel for parties.
This petition has been preferred seeking the following relief:-
"(a) Issue a Writ, order or direction in the nature of Mandamus commanding the respondent No.2 to recheck the answer of O.M.R. Sheet in Assistant Teacher Recruitment Examination 2019."
The Court notes that the prayer for reevaluation is addressed in respect of a recruitment process which was initiated in 2019. The petitioner has also not made any effort to obtain a copy of the OMR Sheet by invoking the provisions of Right to Information Act, 2005. Additionally learned counsel has failed to establish even prima facie that the questions attempted by the petitioner have been wrongly evaluated as per the answer key. The answer key in fact is also not questioned. In the absence of any manifest or apparent error having been established to have been committed in the process of evaluation and bearing in mind the fact that no provision of reevaluation is stated to have been made, the Court finds no ground to issue the writs as prayed for.
Accordingly the writ petition fails and is dismissed.
