Petitioner had applied for appointment to the post of Constable (Female) in U.P. Police. In the online application form of the petitioner, the petitioner had annexed photograph of someone else, and even signatures also were of some other person. According to the petitioner, this was a mistake caused while uploading the form at the Internet Cafe. According to the petitioner, subsequently she was permitted to appear in the physical efficiency test and at the stage of medical examination, she has been refused consideration on the ground that her photograph and signatures do not match. Submission is that the mistake being inadvertent, the petitioner be allowed to compete for recruitment.
The petition is opposed by learned Standing Counsel. It is pointed out that under Clause 6.4 of the advertisement, the details uploaded online cannot subsequently be permitted to be corrected.
Having heard learned counsel for the parties, this Court is of the opinion that no relief can be granted to the petitioner, in the facts and circumstances of the present case. The advertisement clearly stipulated in Clause 6.4 that online details submitted cannot be subsequently altered. Petitioner admits that the photograph and signatures on her application form were of someone else. The entire selection has been undertaken on the basis of details feeded online. The Court cannot be oblivious of the fact that more than 22 lacs candidates had applied for recruitment. This Court is of the view that if the State authorities, in such circumstances, have scrupulously followed the terms of advertisement, and no illegality is otherwise shown in the process, the aspects of equity and sympathy would not be available to be pressed to interfere with the recruitment involving large number of posts.
Writ petition, accordingly, is dismissed.
