JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 17345 of 2004 Petitioner :- Km. Madhu And Others Respondent :- State Of U.P. And Others Counsel for Petitioner :- Rajendra Pratap Singh,A.K. Srivastava,Devendra Tripathi,Neelamber Tripathi,S.K. Srivastava,V.K.Ojha,V.K.Srivastava,Vikas Budhwar Counsel for Respondent :- C.S.C.,B.N. Singh,D.Tripathi,N.Tripathi,P.S.Bahgel,V.K.Ojha
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press the writ petition. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioners have sought following reliefs:
"(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to regularize the services of petitioners on Class IV posts in the office of U.P. Public Service Commission, Allahabad with effect from the date of their initial appointment.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents to pay regular pay scale alongwith all the allowances applicable to class IV employees in the office of U.P. Public Service Commission as well as arrears of pay with effect from 1.1.96 in pursuance of the order dated 15.3.1990 passed in writ petition No. 14931 of 1990.
(iii) Issue a writ, order or direction in the nature of mandamus restraining the respondents from dispensing with the services of the petitioners pending their regularization"
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting relief as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 26.4.2018 Ravi Prakash
