Grievance of the petitioner is that he has not been extended the benefit of the judgment dated 17 April 2018, passed in Special Appeal No. 93 of 2018 State of U.P. Vs. Rizwan and others. In respect of such grievance petitioner has also approached the Examination Regulatory Authority. It is contended till date no decision has been taken.
Learned Standing Counsel submits that claim of the petitioner shall be considered in light of the order passed by the Division Bench referred to above.
In the facts and circumstances of the case noticed above this petition stands disposed of with the direction upon the respondent no.2 to accord consideration to petitioner claim for grant of benefit in terms of the Division Bench judgement dated 17 April 2018, within two months from the date of presentation of certified copy of this order.
