High Court Of Judicature at Allahabad|30 August, 2019

JUDGMENT / ORDER

By means of the present petition, the petitioner has prayed the following relief(s):
1. "to issue a writ order or direction in the nature of mandamus commanding the opposite party to produce the copy of answer book of this paper of the subject of mathematics before this Hon'ble Court.
2. to issue a writ order or direction in the nature of mandamus commanding the opposite party no.2 to re-evaluate answer book of this paper of the subject of mathematics by the experts of this subject and thereafter issue a fresh mark-sheet to the petitioner.
3. to issue a writ order or direction in the nature of mandamus commanding the opposite parties to consider candidature of the petitioners for appointment as Assistant Teacher as per the result of re-evaluation."
Learned counsel for the petitioner has submitted that the answer book of the subject mathematics has not been properly evaluated as she has awarded lesser marks than her expectations and performance.
Learned Standing Counsel has submitted that the petitioner had earlier filed a writ petition No.3607(S/S) of 2019 for the declaration of the result of the scrutiny applied in the subject of B.T.C. namely English (Saptam Prashna Patra) and Mathematics, which had been disposed of vide order dated 08.02.2019 with direction to the opposite party no. 4 to declare the result of scrutiny of the petitioner within a period of two weeks. Learned Standing Counsel has submitted that in pursuance of the direction issued by this Court on 08.02.2019, the respondent had declared her result after scrutiny of the mark-sheet and the petitioner has not challenged the said result in the instant writ petition.
Leaned Standing Counsel has also submitted that the petitioner has failed to make out any case for granting the relief as made in the present petition. He submits that the present writ petition has no merit and the same is liable to be dismissed.
I have heard both the parties and perused the pleadings of the writ petition.
In compliance of the Court's order dated 08.02.2019, the scrutiny has already been made and the result had already been declared, which is appended as Annexure 1 with the petition. The result is not under challenge in the present petition.
In view of the above facts and circumstances of the case, I do not find any good ground to issue a mandamus, as prayed by the petitioner.
The writ petition being devoid of merit is accordingly dismissed.
