Petitioner's claim for grant of compassionate appointment as also retiral benefits due and payable to petitioner's late father appears to have been forwarded to the Superintendent of Police, Banda on 9th October, 2020. Grievance is that though period of almost a year is about to expire, but till date a decision has not been taken.
Petitioner claims to be daughter from the first wife of the deceased employee while the alleged second wife has also approached this Court by filing writ petition no. 2770 of 2020, which was disposed of with a direction upon the competent authority to take a decision. It is pointed out that the competent authority has rejected such representation. It is urged that petitioner being daughter from the first marriage is entitled to be considered for compassionate appointment. It has also been pointed out that a succession certificate has also been obtained and produced before the authorities and therefore there is no difficulty in considering petitioner's claim now.
As the claim of petitioner is still to be examined, it would be appropriate to dispose of this writ petition with a direction upon the respondent no. 4 to pass appropriate orders upon petitioner's claim, forwarded on 9th October, 2020, by passing a reasoned order within a period of three months from the date of presentation of a copy of this order.
With the above observations, this writ petition stands disposed of.
