Sankaran, J. The appellant filed O.S. No. 123/2005 on the file of the Court of the Subordinate Judge, Cherthala against the respondent for specific performance of an agreement for sale in respect of the plaint schedule property. The trial Court dismissed the suit as per judgment and decree dated 31-3-2008. Challenging the above judgment and decree, the plaintiff has come up in appeal.
2. When the appeal came up for hearing, the matter was referred for mediation. The parties have settled their disputes and differences before the Mediation Centre, and a memorandum R.F.A. NO. 669 OF 2008-A 2 of settlement dated 20th September, 2014 was executed and signed. The terms of the memorandum of settlement read as follows:
1. Respondent agreed to pay an amount of Rs. 25,000/- to the appellant, in full and final settlement and the appellant received the same. In view of the said payment, the matter has been settled between the parties.
2. Both parties agreed that they will not make any further claim.
The memorandum of settlement is recorded. In view of the above settlement, the dismissal of the suit is confirmed and the appeal stands dismissed.
