JUDGMENT / ORDER

In this matter, the election officer filed a statement stating that the election has been concluded. The Advocate Commissioner also reported that elections are over. In view of the above, nothing further survives in this writ petition. However, impleaded additional 7th and 8th respondents submitted that they are contemplating to initiate legal proceedings challenging the election. It is also submitted that the Advocate Commissioner shall not hand over the custody of the documents to the elected office bearers. The Advocate Commissioner submits that he has placed all these records in a safe room and key is in his custody.
In view of the above, the Commissioner shall keep the custody of the key till 30.10.2014. Thereafter, he shall handover the key to the Secretary of the Sabha as against receipt. It is W.P.(C) No.24407 of 2014 2 reported that the remuneration fixed by this Court was too low considering the work discharged by the Advocate Commissioner and his assistants.
Considering the facts and circumstances, the Advocate Commissioner shall be paid an additional remuneration of Rs.25,000/- and Rs.10,000/- each to all assistants engaged by him. This amount shall equally be shared by the petitioner and the Sabha.
The writ petition is closed.
