JUDGMENT / ORDER

A.M.Shaffique J Petitioner has approached this court seeking for a direction to respondents 1 and 2 to provide adequate police protection to the life of the petitioner and other trust members and for the smooth conduct of 'Ayyappan Vilakku' to be held on 13.12.2014. 2. According to him, the trust, which is a registered one, has already taken steps to conduct 'Ayyappan Vilakku' on 13.12.2014. The third respondent, taking law into his own hands, with his men has openly declared that he will not permit the function to be held peacefully.
3. On a perusal of the averments in the writ petition, it is apparent that there is some dispute between the petitioner and the third respondent with regard to the conduct of the 'Ayyappan Vilakku'. In fact, Police cannot interfere in civil matters and in the said circumstances the remedy of the petitioner is to approach the civil court and seek for appropriate reliefs. Police WP(C) No. 32702/14 2 can interfere only if there is law and order situation. The petitioner apprehends law and order situation and fairly submits that the third respondent is intending to interfere with the conduct of 'Ayyappan Vilakku'. In such circumstances, we do not think that any direction as prayed for can be issued in favour of the petitioner.
Reserving the liberty of the petitioner to approach the civil court to seek appropriate remedy, this writ petition is dismissed.
