The petitioner in the original petition, who is working as Engineer in the Vikram Sarabhai Space Centre (VSSC), Thiruvananthapuram, filed I.A.No.7887 of 2014 seeking permission to withdraw the above O.P. The counsel for the petitioner submitted that during the pendency of the above O.P., the Scrutiny Committee for Verification of Community Certificates enquired the matter with regard to the status of the petitioner and came to a conclusion that he belongs to Ezhava community and no benefit for scheduled caste will be available to him. Copy of the proceedings of the Scrutiny Committee is produced as Ext.P109. In view of the decision of the Apex Court reported in R. Unnikrishnan v. V.K. Mahanudevan [(2014) 4 SCC 434] he is entitled to get the benefit from 30.08.2007. In the circumstances, I.A.No.7887 of 2014 is allowed and O.P.No.937/1998 is dismissed as withdrawn with the above observation.
