JUDGMENT / ORDER

Petitioner apprehends arrest by the Kadirur Police in Crime No.504 of 2013 for the offenes punishable under Secs.365, 392 and 471 of the Indian Penal Code. 2. Learned Public Prosecutor has opposed the application. It is submitted that the persons accused in Crime No.504 of 2013, on 02.08.2013 at about 12.30 hours followed the defacto complainant who was riding a motorcycle, in a car, restrained him, abducted and robbed him of Rs.5,200/-. The petitioner is involved in two other cases of similar nature. Involvement of the petitioner is suspected. Interrogation is required. Petitioner is not so far arrayed as an accused. He was given notice to appear before the officer investigating the case for interrogation.
3. Learned counsel submitted that the petitioner is being suspected merely for the reason of his alleged involvement in other cases.
4. The petitioner has to be interrogated to ascertain his alleged involvement in the case. Grant of pre arrest bail would affect the investigation. Hence, I am inclined to issue directions.
Application is disposed of as under.
1. Petitioner shall surrender before the officer investigating Crime No.504 of 2013 of the Kadirur Police station on 04.07.2014 at 10.00 am for interrogation.
2. In case interrogation of the petitioner is not completed that day, it is open to the investigating officer to direct presence of the petitioner on any other day/days and time which the petitioner shall comply.
3. Petitioner shall co-operate with investigation of the case.
4. In case the petitioner is arrested, he shall be produced before the jurisdictional magistrate the same day where it is open to the petitioner to request for bail with intimation given to the Assistant Public Prosecutor concerned at least two working days in advance.
5. If custody of the petitioner is required for any purpose, the investigating officer also can move application before the learned magistrate.
6. Learned magistrate shall consider the application(s) having regard to all relevant circumstances including whether detention of the petitioner is required and pass appropriate orders as early as possible.
