The petitioner, respondents 2 and 3 and the minor children of the petitioner (Sruthy Xavier and Sherry Xavier) are present. It is submitted by the petitioner and the third respondent that their marriage was dissolved by a decree of divorce dated 18.10.2013 in O.P.No.772 of 2011, Family Court, Ernakulam. GOP No.27/2013 filed by the petitioner for the custody of his minor daughters is pending before the Family Court.
2. The third respondent stated that her minor daughters are with her mother. Sruthi Xavier, the minor daughter of the petitioner, also stated so. It is pointed out that some interim orders WP(Crl.)196/2014 2 were passed by the Family Court for the interim custody of the children. The learned counsel for the petitioner submitted that in these circumstances, the petitioner may be permitted to seek appropriate reliefs before the Family Court and that the Writ Petition may be closed.
Accordingly, the Writ Petition is closed granting liberty to the petitioner to approach the Family Court for appropriate reliefs.
