On 28.5.2014 on the basis of the submission made by the learned counsel for the respondent State I directed the petitioner to pay the admitted amount before the next posting date. This petition has been filed to review the order on the ground that the petitioner has not made any admission.

It is submitted by the learned counsel for the petitioner that the petitioner has not made any admission that he is liable to pay any amount to the Government and, in fact, he was only disputing his liability. In the counter affidavit filed by the respondent State also there is no specific averment that the petitioner has admitted that he is liable to make any payment. So it appears that the order is liable to be reviewed. Accordingly, the R.P. will be allowed.

In the result, this R.P. is allowed and the order passed on 28.05.2014 directing the petitioner to pay the admitted amount is recalled.
