JUDGMENT / ORDER

The petitioner is aggrieved by the non-consideration of the applications filed before the Debt Recovery Tribunal, (Kerala and Lakshadweep) At Ernakulam, numbered as I.A Nos.867 of 2014 and 871 of 2014 for setting aside the ex-parte decree as also condoning the delay for filing the said application. Admittedly the said applications were filed only on 01.04.2014. As per the report of the Debt Recovery Tribunal called for by this Court, the interlocutory applications are posted to 19.06.2014. Despite the service of notice to the respondent Bank, there is no appearance herein. Very many allegations are made in the writ petition against the Recovery Officer. However, this Court is not going into the same at this point of time. In any event, since applications have been filed before the Tribunal to set aside the ex-parte decree, though the same are reported to have been filed in April, 2014, in the circumstances, which come to fore in the OPDRT 42/2014. : 2 :
instant case there shall be a direction to the Tribunal to consider the applications before the 1st of September, 2014. It is also made clear that the respondent Bank or the recovery officer shall not proceed with any sale till 01.09.2014.
Writ petition disposed of as above. No costs.
