JUDGMENT / ORDER

The limited prayer in this original petition is for a direction to the Munsiff Court, Pathanamthitta to take up I.A.No.514/2007 in O.S.No.84/2003 pending before that court and dispose of it as expeditiously as possible. 2. The petitioner is the 2nd plaintiff in the suit namely, O.S.No.84/2003 which was dismissed for default. On an earlier occasion, when the suit was pending consideration, a commission was issued and the Commissioner filed a report. The petitioner seems to have serious objection to the Commissioner's report and in fact it is for the purpose of examination of the Advocate Commissioner it is alleged that he had filed I.A.No.514/2007. In the light of the fact that the suit was earlier dismissed for default, that petition was not attended to.
3. The petitioner points out now that the suit has been restored to file, it is necessary that I.A.No.514/2007 is disposed O.P.(C) No.3050/2014 2 of at the earliest.
4. In the light of the order that is proposed to be passed, it is felt that notice to the respondents is unnecessary.
This original petition is disposed of with a direction to the Munsiff Court, Pathanamthitta to take up I.A.No.514/2007 in O.S.No.84/2003 pending before it and dispose of the same in accordance with law as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a copy of this judgment.
