K.Jayamani vs The Chairman

Madras High Court|23 November, 2017

JUDGMENT / ORDER

The present Writ Petition has been filed seeking issuance of Writ of Mandamus to direct the respondent to consider and dispose of the representation given by the petitioner on 19.10.2017.
2.Heard Mr.D.Rajagopal, learned Counsel appearing for the petitioner; Mr.R.A.S.Senthil Vel, learned Additional Government Pleader appearing for the respondent.
3.The petitioner has obtained B.Lit. from Annamalai University and also B.Ed. Degree during the academic year 2016-17. Pursuant to the Notification issued by the Tamil Nadu Teachers Recruitment Board for Teachers Eligibility Test in March 2017, the petitioner appeared and passed in the Teachers Eligibility Test examination. It is stated that he has also scored 84 marks out of 150. Subsequently, when the Teachers Recruitment Board calls for certificate verification from the successful candidates, the petitioner took part in the certificate verification held on 24.07.2017 and produced all his certificates. Since, the University has not issued B.Ed. certificate, the petitioner was granted time to produce the same. After obtaining B.Ed. Degree certificate, the petitioner requested the respondent to give a chance to participate in the certificate verification. Since the petitioner's request was not considered, he sent a representation on 19.10.2017 by registered post to the respondent seeking one more opportunity to participate in the certificate verification to produce B.Ed. certificate for verification. This has not been considered. Therefore, the petitioner is before this Court seeking a direction to consider his representation.
4.In view of the above facts and circumstances of the case, without going into the merits of the claim made by the petitioner, this Court directs the petitioner to give a fresh representation to the respondent enclosing copies of certificates of B.Lit and Diploma in Teacher Education and the certificate showing pass in Teachers Eligibility Test, within a week from the date of receipt of a copy of this order and on receipt of the same, the respondent is directed to consider the same and pass appropriate orders in accordance with law.
With the above direction, the Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
