Heard learned counsel for the appellant and the learned counsel for the 3rd respondent.

This appeal has been filed against the judgment dated 24/10/2014 of the learned Single Judge dismissing W.P.C.No.24770/2014 filed by the appellant herein challenging the decision of the University, Ext.P7. The writ petitioner, who intended to conduct a Pharmacy course, had submitted an application, after obtaining permission from the All India Council for Technical Education (AICTE), Ext.P2 dated 10/06/2014. University, by Ext.P7, had informed the petitioner that the request for provisional affiliation of new Pharmacy course shall be considered only on getting approval of the Pharmacy Council of India (PCI) and further the admission of B.Pharm course during the academic year 2014-2015 is closed.
3. Learned counsel for the University submits that admissions were completed in August 2014 as per the schedule fixed by the Supreme Court and hence the University rightly rejected the request submitted by the appellant.
4. The learned counsel for the appellant referring the order of the Apex Court passed in Special Leave to Appeal No.7277/2014 submits that schedule was extended in so far as permission by AICTE, till 10/06/2014 and by that date, the appellant had obtained approval from AICTE.

Be that as it may, the intention of the said schedule for the purpose of permission by AICTE does not extend any benefit to the petitioner/appellant in the context of other schedule dates which are to be complied. The University, in refusing to grant affiliation on the ground that admissions are over for the year 2014-2015 did not commit any error. It is open for the appellant to make a fresh request for the next academic year 2015-2016 with the approval of AICTE which has already been granted for two years.
With these observations, this appeal is dismissed.
