Heard learned counsel for the applicant.
A writ petition preferred by the applicant was disposed of with a direction to the concerned S.D.O. to enquire into the complaint made in respect of encroachments made on public utility land and to take such further action as may be warranted in the facts and circumstances of the case. Learned counsel for the applicant does not dispute the legal position that in terms of the provisions of Section 67 of the U.P. Revenue Code, 2006 it is the Assistant Collector/Tehsildar who has to take action and ensure that encroachments made on public utility land are rid. He therefore prays for liberty to approach the concerned Assistant Collector/Tehsildar for redressal of his grievance.
In view of the above and in the interest of justice, this petition shall stand disposed of with permission to the applicant to approach the concerned Assistant Collector/Tehsildar along with a detailed representation providing all particulars of the alleged encroachments within a period of two weeks from today. In case such an application is made the Assistant Collector/Tehsildar shall ensure that an appropriate enquiry is initiated and further action taken in accordance with law. The Assistant Collector/Tehsildar shall endeavour to dispose of proceedings with expedition and preferably within a period of two months from the date of making of the representation.
