Heard learned Senior Advocate Mr. R.S. Sanjanwala with learned advocate Mr. Yash Joshi for the petitioner. Mr. Sanjanwala submits that by an order dated 2.2.2007, the petition was not entertained against which the petitioner had approached the Division Bench of this Court by way of filing Letters Patent Appeal No.247 of 2007. Mr. Sanjanwala points out that by order dated 27.11.2008 passed by the Division Bench of this Court (Coram: Hon'ble the Chief Justice Mr. K.S. Radhakrishnan, as he then was and Hon'ble Mr. Justice Akil Kureshi), the said Letters Patent Appeal has been allowed and the order dated 2.2.2007 has been quashed and set aside and the main matter is accordingly placed for further hearing on merits.
Hence, NOTICE returnable on 1.8.2012. Direct service is permitted.
