This application under Section 482 Cr.P.C has been moved with a prayer to direct the court below to decide the S.T. No. 190 of 2018 arising out of case crime no.263 of 2018 under sections 302 IPC, Police Station Kotwali, District Jhansi.
It is argued by the learned counsel for the applicant that a direction may be issued to the trial court to decide this case expeditiously. He has further argued that in this case six witnesses have been recorded and since thereafter the case is not proceeding.
From a perusal of the order-sheet, it appears that PW-6 was recorded on 31.1.2020 and thereafter the case was not listed for remaining evidence. It appears that thereafter corona pandemic has hit the country because of which the courts were not functioning properly which might have resulted in delay and now the Courts are working.
It is directed that the court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from today, if there is no legal hurdle, without permitting undue adjournments to either side.
With this direction, this application is disposed of.
