The petitioner claims that her husband Heera Lal died on 18.10.2016 and his dead body was recovered from village Koat Kamhariya, P.S. Purandarpur, District Maharajganj and he was a sole bread earner of the family.
The petitioner claims that she was entitled to a claim under the scheme floated by the State Government known as Mukhyamantri Kisan Evam Servahit Bema Yojana. The petitioner filed a claim on 29.06.2018. However, the said claim has not been decided as yet.
Considering the averments made by the petitioner in the writ petition, we direct the respondent nos. 2 and 3 to pass orders on the claims petition filed by the petitioner on account of death of her husband expeditiously preferably within a period of two months from the date of production of a certified copy of this order.
In the event the claim petition is rejected, which the petitioner states has been done orally, the petitioner should move an application before the District Magistrate, who will decide the cause of the petitioner in accordance with the provisions of Mukhyamantri Kisan Evam Servahit Bema Yojana expeditiously within a further period of two months.
It is made clear that we have not expressed our opinion on the merit of the case and the decision as recorded above shall be taken by the authority concerned expeditiously in accordance with law.
With the aforesaid observation the writ petition is disposed of.
