2. In the facts and circumstances of the case and with the consent of learned advocates appearing on behalf of the respective parties, the present application is taken up for final hearing today.
3. The present Misc.Civil Application has been preferred by the applicant herein - original appellant - plaintiff to restore Second Appeal No.106 of 2011 as well as Civil Application No.5531 of 2011, which came to be dismissed for non-prosecution by this Court vide order dated 26/03/2012.
4. Having heard learned advocates appearing on behalf of the respective parties and considering the averments in the application, the present Misc.Civil Application is allowed and Second Appeal No.106 of 2011 as well as Civil Application No.5531 of 2011 are restored to file.
