1. Today when the present Second Appeal is taken up for hearing, Mr.M.S.Shah, learned advocate appearing for Mr.N.R.Joshi, learned advocate appearing on behalf of the appellant and Mr.Champaneri, learned advocate appearing on behalf of the respondents, have jointly stated at the bar that as such the parties have settled the dispute amicably and respondents have agreed to pay a sum of Rs.3,51,000/- to the appellant and on that, the appellant has agreed to execute the deed for cancellation of the sale deed dated 04/09/1996 registered with office of Sub-Registrar,Wadhvan and has agreed to forgo all his right, title and interest in the disputed suit property in question and has agreed to withdraw the present Second Appeal.
2. It is reported that out of the aforesaid amount of Rs.3,51,000/-, Demand Draft of Rs.1,51,000/- is given to Mr.M.S.Shah, learned advocate appearing on behalf of the appellant today and respondents have agreed to pay balance Rs.2,00,000/- to the appellant within a period of 15 days from today. Therefore, learned advocates appearing on behalf of the respective parties have requested to adjourn the matter to 12/04/2012 so as to enable the respondents to make payment of the balance amount of Rs.2 Lacs to the appellant and place it on record consent terms singed by the parties so that the present Second Appeal can be withdrawn by the appellant.
