JUDGMENT / ORDER

The applicant/prisoner has taken-out this application for seeking furlough leave on the ground of his urge to be with his family. The Court is informed by learned APP that the present applicant had infact misused this liberty and did not report in time when he was released on furlough leave for 14 days. He was released on 03/10/1996 and he was to report on 18/10/1996 at 12:00 O'clock. He had to be brought by police on 29/06/2010. Thus, for the period of 5002 days, he remained unauthorizedly and hence, he had committed an offence for which the penalty forefitting of furlough is imposed upon him. The order dated 01/06/2010 is along with other paper are placed on record. The appeal preferred against the order is also rejected on 11/11/2011 and that order has not been challenged in any manner. Today, before this Court a prayer is made only for seeking furlough leave. The Court is of the view that the prisoner has a consistent tendency to misuse the liberty. The right to furlough could not be successfully exerted before this Court. Hence, this application is dismissed. The applicant/prisoner be informed accordingly.
