JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The learned counsel Ms.Sacheti states that the appellant herein together with the other co-convict has already filed appeal being Criminal Appeal No.1562/11 on 20.12.2011 and therefore, she seeks permission to withdraw the present appeal together with the averments made therein since the appeal second time would not survive. She also stated that in the appeal which has been preferred by Mr.Dagli, he has not preferred any bail application for the appellant herein, who is appellant no.3 in the said appeal.
Therefore, it was requested that if the bail application is filed in the said appeal, withdrawal of the present appeal may not operate as successive bail application in the said appeal.
All the applications with the appeal shall stand disposed of as withdrawn.
Since the appeal is withdrawn, naturally the question of successive bail application may not arise in the said appeal preferred in Criminal Appeal No.1562/11.
