Supplementary affidavit filed today by learned counsel for the applicants is taken on record.
Heard learned counsel for the applicants and learned Additional Government Advocate for the State.
Present application under Section 482, Cr.P.C. has been filed with the prayer to quash the charge sheet and entire criminal proceedings in Case No. 835/2017, arising out of Case Crime No. 46 of 2016, under Sections 498A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, Police Station Mahila Thana, District Agra, pending in the court of Additional chief Judicial Magistrate, Court No. 10, Agra. It has further been prayed to stay the further proceeding of the aforesaid case.
There is matrimonial dispute between the complainant and the applicants and the matter had already been settled between them. The compromise was verified by Additional chief Judicial Magistrate, Court No. 10, Agra vide order dated 7.4.2018, certified copy of the same is appended as Annexure SA-2 to the supplementary affidavit.
In view of above, proceedings of the aforesaid case are quashed. The application stands allowed.
