THE HON’BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No. 102 of 2012 ORDER:
This criminal petition is filed to quash FIR in crime No.127 of 2011 of Karkhana Police Station for the offences under Sections 376, 420, 313, 506, 509, 292, 500 and 323 IPC.
2. Heard both sides.
3. According to the learned Public Prosecutor, because of the stay granted by this Court, investigation could not be proceeded with.
4. The ground urged on behalf of the petitioner cannot be decided at this stage because there are serious allegations leveled against the petitioner and the correctness of those allegations can be appreciated only if a full-fledged investigation is taken up. Since the FIR is of the year 2011, I deem it appropriate to direct the police to expedite the investigation as early as possible and file the final report and by giving liberty to the petitioner to challenge the final report, this petition is disposed of.
5. Accordingly, the criminal petition is disposed of.
6. The vacate petition is closed in view of the disposal of the criminal petition.
