JUDGMENT / ORDER

1. Heard learned Counsel for the petitioner.
2. It is submitted that the Notice issued vide order dated 15.10.2012 could not be served due to non- availability of the respondent / plaintiff.
3. In view of the above, it is submitted that the petitioner be permitted to carry out the notice by way of substitution.
4. Hence, issue fresh NOTICE returnable on 27th November, 2012 and permission to serve the unserved respondent/s by way of substitution is hereby granted.
