Heard learned counsel for the parties.
During the course of arguments, learned counsel for the petitioner has submitted that for the property in question one Civil Suit bearing No.73/05; Kishore Kumar vs. Principal, Jai Narayan Post Graduate, Degree College, Lucknow was filed before the court of Civil Judge and the said suit was decreed on 17.08.2009 by the IInd Additional Civil Judge (Junior Division), Court No.34, Lucknow holding that the plaintiff/ petitioner hereto being a tenant of the college may not be evicted by the college except in accordance with law.
Learned counsel for the college has submitted that he is not aware about the aforesaid order.
Learned counsel for the petitioner is directed to provide the photocopy of the judgment and decree dated 17.08.2009 to the learned counsel for the college so that the aforesaid facts could be verified by him.
Learned counsel for the petitioner has also submitted that against the judgment and decree dated 17.08.2009 the college in question has filed an appeal before the court concerned but he is not aware about the order of the appeal as it has been submitted that the aforesaid appeal has also been finally decided.
Since the aforesaid facts are to be verified by the learned counsel for the college in question, therefore, the college may not be compelled to issue 'No Objection Certificate'.
