In view of the endorsement, learned counsel, Mr.H.J. Nanavati was directed to take steps. Learned counsel addressed a letter through Registered Post A.D., which has been returned with an endorsement 'left'. He further states that he has no instruction and it appears that the appellant has also no desire to proceed further with the matter.

In the circumstances, the present First Appeal stands dismissed for non-prosecution. However, at the request of learned counsel, Mr.H.J. Nanavati, liberty is reserved to move in case of difficulty.
