Heard Sri Dinesh Kumar Mishra, learned counsel for the petitioners and the learned Standing Counsel.
This writ petition is preferred for seeking a direction in the nature of mandamus commanding respondent no.3 / S.D.M, Tehsil and District Ghaziabad to decide the application dated 28.10.2017 filed by petitioner under Section 76(2) of U.P. Revenue Code, 2006, within a stipulated period.
The learned Standing Counsel submits that no useful purpose would be served by keeping the petition pending and it may be disposed of by giving an appropriate direction to the authority concerned.
The writ petition is, therefore, disposed of with a direction to respondent no.3 / S.D.M, Tehsil and District Ghaziabad to decide the application dated 28.10.2017 filed by the petitioner under Section 76(2) of U.P. Revenue Code, 2006, as expeditiously as possible, preferably within one month from the date of production of certified copy of the order, in accordance with law.
